1. Introduction

Welcome to The Success Diary("the App"), operated by Samuel Vančo("we", "our", or "us").

The Success Diary is an AI-powered mobile application designed to help users journal their thoughts by voice or text and receive personalized AI-generated feedback, insights, and suggested next steps.

These Terms of Service constitute a binding agreement between you and us and serve as the End User License Agreement (EULA) for the App. By downloading, accessing, or using the App, you agree to these Terms of Service.

If you do not agree to these Terms, please do not use the App.

2. Eligibility

You must be at least 13 years old to use the App.

By using the App, you represent that you meet this minimum age requirement.

3. Description of the Service

The Success Diary allows users to:

  • Record journal entries by voice (transcribed to text) or by typing
  • Receive personalized AI-generated feedback after each entry, including an acknowledgment, an insight, and a suggested next step
  • Continue conversations with the AI by replying to feedback
  • Choose from four feedback styles: Supportive, Direct, Coach, or Balanced
  • View their full journal history and track progress over time
  • Use starter prompts when they need help getting started
  • Optionally record a personal "Manifesto" audio clip

The App is intended to provide a personal thinking tool for self-reflection and goal-oriented journaling.

Access to the App requires a Premium subscription (monthly or annual) or the Lifetime in-app purchase. Some users may see a limited-time free trial on the subscription plans as part of ongoing A/B testing; availability of a free trial is not guaranteed for every user. 4. Mental Health Disclaimer

The Success Diary does not provide therapy, counseling, medical advice, diagnosis, or treatment.

The AI-generated feedback and insights provided by the App are for personal reflection and informational purposes only.

The App is not a substitute for professional mental health services, therapy, or medical care. It should not be relied upon for clinical decision-making or as a replacement for qualified professional guidance.

If you are experiencing a mental health crisis, emotional distress, or thoughts of self-harm, please contact a qualified healthcare professional, call your local emergency services, or reach out to a crisis helpline immediately.

By using the App, you acknowledge that the AI-generated feedback may not always be accurate, complete, or appropriate for your specific situation, and you use it at your own discretion.

5. User Content

Users may submit content including:

  • Voice recordings (which are transcribed to text)
  • Written journal entries
  • Replies and messages within conversation threads

You retain ownership of the content you submit.

By submitting content to the App, you grant us a limited, non-exclusive license to process that content solely for the purpose of providing the App's functionality, including generating AI feedback and storing your journal history.

We do not claim ownership of your content and will not use it for any purpose other than delivering the App's core functionality.

You are responsible for ensuring that any content you submit does not violate any applicable laws or third-party rights.

6. AI-Generated Content

The feedback and responses generated by the App are produced by artificial intelligence. This content:

  • Is not professional advice — it should not be treated as therapy, medical advice, financial advice, legal advice, or any other form of professional guidance
  • May not always be accurate, complete, or appropriate for your specific situation
  • Is generated based on the text you provide, your selected feedback style, and the conversation context
  • Should be used as a tool for personal reflection, not as a definitive source of guidance
  • May vary in quality and relevance across different topics and situations

We do not guarantee the accuracy, reliability, or suitability of any AI-generated content. You are solely responsible for any decisions or actions you take based on the App's feedback.

7. Data and Privacy

The App may process and store certain information necessary to operate the service. This may include:

  • Your first name and feedback style preference
  • Sign-in identifiers (via Sign in with Apple, Sign in with Google, or anonymous sign-in)
  • Journal entries, AI-generated feedback, and conversation history
  • Optional Manifesto audio recordings
  • Anonymous usage analytics

The App relies on the following third-party providers: Supabase (authentication, database, and encrypted storage), Google Gemini (AI feedback generation), PostHog (anonymous analytics), and RevenueCat together with the Apple App Store (subscription and in-app purchase management). Voice journal entries are transcribed using Apple's Speech Recognition framework.

8. Subscriptions and In-App Purchases

The Success Diary offers the following paid plans, all processed through the Apple App Store and managed by our subscription provider RevenueCat:

Plans and Pricing

  • Monthly subscription$7.99 USD per month, auto-renewing.
  • Annual subscription$49.99 USD per year, auto-renewing.
  • Lifetime access$99.99 USD, one-time in-app purchase (non-subscription).

Prices shown are the current USD tier prices. Your local store price may vary based on your country and Apple's pricing matrix, and will be displayed in your local currency at the point of purchase.

What Premium Unlocks

Premium (monthly, annual, and lifetime) unlocks unlimited journal entries, voice journaling, conversation mode, and all four feedback styles (Supportive, Direct, Coach, Balanced).

Payment and Auto-Renewal

  • Payment is charged to your Apple ID upon confirmation of purchase.
  • Monthly and annual subscriptions automatically renew at the same price and duration unless auto-renewal is turned off at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • You can manage or cancel your subscription, and turn off auto-renewal, through your Apple ID Account Settings on your device.
  • The Lifetime plan is a one-time in-app purchase and does not auto-renew.

Free Trial (Where Available)

As part of ongoing A/B testing, some users may be offered a 3-day free trial on the monthly or annual plan. Free trials are not guaranteed for every user.

  • Free-trial eligibility is determined by Apple and by our current A/B assignment.
  • A free trial is limited to one per Apple ID, in line with Apple's free-trial rules.
  • If you choose to purchase a subscription during a free-trial period, any unused portion of the free trial is forfeited.
  • To avoid being charged, cancel in Apple ID Account Settings at least 24 hours before the trial ends.

Refunds

All refund requests are handled by Apple in accordance with Apple's refund policies. We do not directly store or have access to your payment information.

All purchases made through the App are subject to the Apple Media Services Terms and Conditionsand Apple's payment policies.

9. Acceptable Use

You agree not to:

  • Use the App for any unlawful purposes
  • Upload harmful, illegal, abusive, or threatening content
  • Attempt to interfere with or disrupt the App's operation or infrastructure
  • Attempt to gain unauthorized access to the App's systems, servers, or databases
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of any part of the App
  • Use the App to generate content intended to harm, harass, or deceive others
  • Use automated tools, bots, or scripts to interact with the App
  • Exploit the App or its AI capabilities for purposes other than personal journaling

10. Intellectual Property

The Success Diary, including its design, features, branding, user interface, and underlying technology, is the intellectual property of Samuel Vančo.

You may not copy, modify, distribute, sell, or create derivative works based on the App or any of its content without our prior written permission.

11. Service Availability

We may update, modify, or discontinue parts of the App at any time without prior notice.

We do not guarantee that the App will always be available, uninterrupted, or error-free. Service may be affected by maintenance, updates, or circumstances beyond our control.

12. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for:

  • Any decisions, actions, or outcomes resulting from AI-generated feedback or insights
  • Any emotional, psychological, or mental health impact from using the App
  • Loss of data, journal entries, or account information
  • Service interruptions, downtime, or technical failures
  • Any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
  • Any reliance on AI-generated content as professional advice

Use of the App is at your own risk. The App and all AI-generated content are provided "as is" without warranties of any kind, whether express or implied.

13. Indemnification

You agree to indemnify and hold harmless Samuel Vančo and The Success Diary from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

14. Termination

You may stop using the App at any time. You may also delete your account and all associated data from within the App's settings.

We reserve the right to suspend or terminate your access to the App if you violate these Terms or engage in behavior that is harmful to the service or other users.

15. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Slovakia.

16. Changes to These Terms

We may update these Terms from time to time.

When changes are made, the Effective Date at the top of this document will be revised.

Continued use of the App after updates constitutes acceptance of the revised Terms.
